concerning use of the VOICE Project Platform, including the VOICE blog and online training on the Moodle platform

These Terms of Use regulate the relations between the VOICE partnership and visitors/registered users on the VOICE Project Platform, regardless of being juridical or natural persons, including creation and publishing of content on the VOICE blog by those users.
The VOICE Project Platform consists of the main website (https://ethicaljournalism.eu/), Blog (https://training.ethicaljournalism.eu/blog/), and online training on Moodle (https://training.ethicaljournalism.eu/).
Any visitor and registered user of the VOICE Project Platform is entitled to access the information available on it and publish content on the VOICE blog under the conditions set forth.
By browsing our website or using its functions, you (as a visitor or registered user) agree to the following Terms of Use, Privacy Policy, and Cookies Policy. If you do not agree with these terms and policies, we kindly ask that you refrain from using the website.
Introduction
Once you complete your registration you will enter into a contract with the VOICE partnership for the services provided on our platform in accordance with the provisions of these Terms of Use.
It is the goal of the VOICE partnership to keep the information on this website timely and accurate. If errors are brought to our attention, we will try to correct them.
It is our goal to minimise disruption caused by technical errors. However, some data or information on our site may have been created or structured in files or formats that are not error-free, and we cannot guarantee that information will not be interrupted or otherwise affected by such problems. The VOICE partnership accepts no responsibility with regard to such problems incurred as a result of anyone using this site or any linked external sites.
This disclaimer is not intended to limit the liability of the VOICE partnership in contravention of any requirements laid down in applicable national or European law nor to exclude its liability for matters which may not be excluded under those law regulations.
Users and Authors
We process your data securely and in compliance with applicable legislation and commitment to ethical behaviour. For details on how your personal data is collected, stored, and processed, please refer to our Privacy Policy.
A registered user can contribute by publishing articles and suggesting topics.
Authors are those users of the VOICE Project Platform, who are creating a blog on our Moodle platform. As an author, you agree to abide by the following terms and conditions. Please read them carefully.
The name of the author will be published together with the article.
User / Author Rights and Responsibilities
- Your Content, Your Ownership: As an author of the content, you always own the copyright. You retain full ownership of the content you post on the VOICE Project Platform, specifically on the blog. This means you have the right to modify, delete, or share your content elsewhere as you see fit.
- You declare that you will not use the VOICE Project Platform for any activities that are in violation of the laws of the European Union and its Member States, of good manners, and of generally recognized ethical and moral principles.
- You are solely responsible for the content you post on your blog. You agree not to post content that is illegal, offensive, defamatory, or harmful to others. This includes, but is not limited to, hate speech, threats, and sexually explicit content.
- You are aware that if you use the VOICE Project Platform for any activities and content that are in conflict with the criminal code, other laws and rules and regulations and general moral and ethical rules, you will bear full legal responsibility for your actions. You are aware that the VOICE partnership members bear no responsibility for such possible activities done and content created by users/authors.
- You agree to respect other users of our platform. Harassment, bullying, or any form of discrimination will not be tolerated.
- You agree to respect the privacy of others. Do not post personal information about others without their explicit consent.
- You agree not to post content that infringes on the intellectual property rights of others. This includes copyright, trademark, and patent rights.
Our Rights
- The VOICE partnership members accept no responsibility or liability whatsoever with regard to the information published by authors on this website. However, the content that is containing or promoting the following will not be published on the VOICE Project Platform: violation of rules of a professional journalism as stipulated by the IFJ, hate-speech, violence, copyright protected material used without appropriate licence, sexually explicit content, child abuse, or any other violetion of human rights and freedoms.
- We reserve the right to moderate the content posted on our platform to ensure compliance with these terms and conditions.
- We reserve the right to remove any content that we deem inappropriate or in violation of these terms and conditions, without prior notice.
- We reserve the right to terminate or suspend access to our platform for users who violate these terms and conditions.
- The publication of the content by authors on the VOICE Project Platform does not constitute an endorsement of the contents, which reflect the views only of the authors, and the owner of the VOICE Project Platform cannot be held responsible for the content and any use which may be made of the information contained therein.
Licence and Intellectual Property
The VOICE Project Platform and materials created by the VOICE partnership are published under a Creative Commons License CC BY-NC-SA 4.0. For more information about the licence, please check this website: https://creativecommons.org/licenses/by-nc-sa/4.0/.
The works of the authors published on the VOICE Project Platform are protected by the copyright licence, but each author declares that they are aware of the possibility their work can be used under the fair use principle.
Specifically, by publishing the content on the VOICE Project Platform you grant the VOICE partnership members a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your blog content for non-commercial, educational, and promotional purposes directly related to the VOICE project. This licence is an equivalent to the CC BY-NC-SA 4.0, under which your content will be also made available on the VOICE Project Platform. The licence is granted at the time of the publication of the article by its author on the VOICE Project Platform.
Without derogation to other parts of these Terms and Conditions, it means you, as an author, will be always given an appropriate credit, the content will be used for the non-commercial purposes only, and the VOICE partnership members will not make any derivative works based on the article nor encourage others to do so.
That means the VOICE partnership members can distribute the content via the VOICE Project Platform and share the link to the content on other websites, social media, and through newsletters or other means of electronic communication related to the VOICE project or that are managed/owned by the members of the VOICE partnership.
As an author, you agree that the editors have the right to not publish the entire content of the article and that the original article remains stored in the archive of the editorial system.
In the case the VOICE partnership members would like to directly publish the content on the other platforms, i.e. not in the form of hyperlink placed on the website or social media (further publication), or if they would like to publish again the content that was deleted by the author from the editorial system, they will always ask author for the new licence.
Modification and opt-out: If you do not wish for your content to be used by the VOICE project beyond our platform itself, you can easily modify the license. Simply indicate your preference in your blog settings or contact the VOICE Project Coordinator. The licence is also automatically revoked by you by an act of deleting the original and, if applicable, edited content.
Third-party Websites
The VOICE Project Platform includes references and links to external resources (“external links”) in domains other than https://ethicaljournalism.eu/ which are not owned or created by the VOICE partnership, over which the VOICE partnership has no control, and for which the VOICE partnership assumes no responsibility (for the availability, quality of the external content, truthfulness, and conformity with the law of such websites and resources).
When visitors or users of the VOICE Project Platform choose to follow a link to any external website, they leave the official domain of the VOICE project and are subject to the cookie, privacy and legal policies of the external website. Compliance with applicable data protection and accessibility requirements of external websites linked to from the VOICE Project Platform, falls outside the control of the VOICE partnership and is the explicit responsibility of the external website. We encourage you to review the privacy policies of those third-party websites.
The VOICE partnership makes no third-party websites’ representations. When you access such a website, you do so at your own risk. The VOICE partnership is not responsible for the reliability of any data, opinions, advice, or statements made on third-party sites.
The VOICE partnership provides these links merely as a convenience. The inclusion of such links does not imply that the VOICE partnership endorses, recommends, or accepts any responsibility for the content of such sites.
Third-party products and services
The purpose of any linked reference from the VOICE Project Platform to any specific external resource, online service or a website, is to enhance the information available on the VOICE Project Platform and help visitors and users to reach those websites.
Such linked references do not constitute endorsement by the VOICE partnership or the European Commission of the specific external resource, online service or a website; nor recommendation related to or endorsement of the information, products, or services contained in the linked reference; nor endorsement of the organisations owning the external websites.
Takedown Policy
By making materials – not limited to works published by the authors – available online, the VOICE partnership acts in good faith. However, despite these safeguards, we recognise that from time-to-time material published online may be in breach of copyright laws, contain sensitive personal data, or include content that may be regarded as obscene or defamatory. If you are concerned that you have found material on our website for which you have not given permission, contravenes privacy laws, is obscene/defamatory and, in terms of copyright law, is not covered by a limitation or exception, please email us stating the following:
- Your contact details.
- The full details of the material.
- The exact and full URL where you found the material.
- If the request relates to copyright, provide proof that you are the rights holder and a statement that, under penalty of perjury, you are the rights holder or are an authorised representative.
- The reason for your request including but not limited to copyright law, privacy laws, data protection, obscenity, defamation etc.
- Upon receipt of notification, the ‘Takedown’ procedure is then invoked as follows:
- We will acknowledge receipt of your complaint by email and will make an initial assessment of the validity and plausibility of the complaint.
- Upon receipt of a valid complaint, the material will be removed from the website pending an agreed solution.
- We will contact the contributor who deposited the material, if relevant. The contributor will be notified that the material is subject to a complaint, under what grounds, and will be encouraged to assuage the complaints concerned.
- The complainant and the contributor will be encouraged to resolve the issue swiftly and amicably and to the satisfaction of both parties.
Account Termination
Besides the cases stipulated in the present Terms of Use, the relation between the VOICE partnership and registered users shall be terminated under the following circumstances:
- the support of the VOICE Project Platform is ceased;
- you terminate your registration;
- in other cases, as provided by applicable law.
Liability
We will exercise due diligence in providing our services to you and will apply appropriate measures for keeping a safe and error-free functioning of the VOICE Project Platform. We do not guarantee that the services provided free of charge will satisfy your requirements. We do not accept responsibility for any damages that might be incurred by you in the course of the use of the services, unless such losses are caused by us intentionally or due to gross negligence. We do not accept responsibility for losses caused by events beyond our reasonable control.
We do not commit to any deadlines for updating the information on the VOICE Project Platform, unless stated otherwise.
You (regardless of being visitor or registered user) agree to indemnify and hold harmless the VOICE partnership as a whole, its members and representatives from any and all claims or demands, including penalty payments, reasonable attorney’s fees, made by any third party related to your breach of these Terms of Use or the applicable laws or violation of the rights of any third party. This obligation shall remain in effect even after the termination of registration, including after the termination of the activity and existence of the VOICE Project Platform itself.
Dispute Resolution
Terms of Use, Privacy Policy, and Cookies Policy of the VOICE Project Platform shall be governed by the law of Romania and the law of the European Union and for all matters not settled by the present Terms of Use and Privacy Policy, the provisions of the EU and Romanian legislation in force shall apply.
In the event of a dispute arising from these terms and conditions, both parties agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiation, either party may seek resolution through mediation or arbitration.
Changes to These Terms
The present Terms of Use are adopted by all members of the VOICE partnership. We may update these terms and conditions from time to time. We will notify you of any changes by posting the new terms and conditions on the VOICE Project Platform and updating the “Last Updated” date at the top of this document.
About the VOICE Project and Our Platform
The VOICE Project Platform, hereafter also referred to as the website, is maintained by the partnership collaborating on the project “VOICE” (grant agreement No 2023-2-RO01-KA220-YOU-000185183, duration 22 months; hereafter referred to as the VOICE or the Project). The purpose of this website is to provide information about the said project and its deliverables, which have been produced with the financial support of the Erasmus+ Programme of the European Union. The contents of the website and publications are the sole responsibility of the VOICE project partnership members and contributors to the website (hereafter also referred to as the Authors) as specified and can in no way be taken to reflect the views of the European Commission. These Terms of Use regulate the relations between the VOICE partnership, authors, and visitors on this website regardless of being organisations or natural persons.

All partners are owners, administrators, and editors of the website.
The VOICE Project Platform is hosted on a VPS property of Fundación Docete Omnes (Spain) in an EU data centre.
